Gift Certificate Terms and Conditions
United Online, Inc. offers Internet access and related services through its wholly owned subsidiaries including, without limitation, NetZero, Inc. and Juno Online Services, Inc. (collectively, “United Online”). The following terms and conditions apply to any United Online gift certificate purchased from United Online (“Gift Certificate”). By purchasing or redeeming a Gift Certificate, you are agreeing to these terms and conditions.
- Gift Certificates expire one year after the date of purchase except if such expiration is prohibited by law, in which case the Gift Certificate will expire as soon after such one year period as allowed by law (the “Term”). Gift Certificates are not refundable or redeemable for cash except as required by law. Certain exceptions are listed below*.
- Gift Certificate values may only be applied to specified services provided, and billed for, by United Online which currently includes NetZero Platinum, Juno Platinum, NetZero HiSpeed and Juno SpeedBand (collectively with other services that United Online may make available for purchase with Gift Certificates, “United Online Services”) during the Term. United Online Services currently excludes Bluelight Internet Services. Gift Certificates may not be used for third party goods or services offered or advertised on the United Online services or sites, even if such goods or services are co-branded with a United Online brand.
- Gift Certificates are not subscriptions to any specific service, service level or service plan. Availability and pricing of United Online Services subject to change at any time. United Online Services and related pricing available at the time of purchase of a Gift Certificate may not be available at the time of redemption of such Gift Certificate. Gift Certificates must be redeemed on an eligible United Online Web site. Gift Certificates may not be redeemable for special offers or discounted plans or services. United Online Services not available in all areas.
- Recipients must accept the terms of service or terms and conditions of the applicable United Online Service to redeem a Gift Certificate.
- New Accounts. A Gift Certificate may be redeemed during the Term for the standard month-to-month plans of the applicable United Online Services unless the recipient has a pre-existing account with a valid alternative payment method as described in the next paragraph. Upon redemption by the recipient, the full amount of the Gift Certificate will be credited to the recipient’s account balance. The applicable monthly service fee for the selected United Online Service will be debited from the account balance each month until the deposited Gift Certificate value is exhausted or insufficient to pay for the full monthly fee, at which point the recipient will be required to provide an alternative payment method to continue service.
- Pre-existing Accounts. A Gift Certificate may be redeemed during the Term for, and the full amount of the Gift Certificate will be credited to the account balance of, an existing United Online account with a valid alternative payment method (such as credit card, electronic check, phone bill payment or an existing pre-paid balance). The applicable service fees for the United Online Service(s) associated with the account will be debited from the account balance instead of charging the alternative payment method until the deposited Gift Certificate value is exhausted or insufficient to pay for the full amount of the applicable service fee(s), at which time United Online will resume charging the alternative payment method. Additional transaction or processing fees that are charged for certain alternative payment methods (such as electronic check or telephone billing processing fees) will not be applied for any service fees that are paid in full from the Gift Certificate account balance.
- United Online has no responsibility with respect to lost, stolen, misdirected or misplaced Gift Certificates. Risk of loss and title of the Gift Certificate pass to the purchaser upon the electronic transmission to the recipient or delivery to the carrier as applicable.
- Gift Certificates (including any excess or unused value) may not be transferred by a recipient.
- United Online has the right to close accounts and/or request alternative forms of payment for United Online Services paid for with fraudulently obtained Gift Certificates.
- UNITED ONLINE HEREBY DISCLAIMS ALL WARRANTIES WITH RESPECT TO GIFT CERTIFICATES, WHETHER STATUTORY OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT. UNITED ONLINE DOES NOT WARRANT OR GUARANTEE THAT ANY PARTICULAR UNITED ONLINE SERVICE WILL BE AVAILABLE OR OFFERED AT A CERTAIN PRICE AT THE TIME OF REDEMPTION. IN NO EVENT SHALL UNITED ONLINE OR ITS SUPPPLIERS BE LIABLE FOR ANY CONSEQUENTIAL, INCIDENTAL, SPECIAL OR PUNITIVE DAMAGES, WHETHER PURSUANT TO CONTRACT, TORT OR OTHER LEGAL THEORY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
* Without limiting the generality of the foregoing:
- Gift Certificates do not expire in California, Illinois, Rhode Island and Maine;
- Gift Certificates expire two years after purchase in Hawaii and Massachusetts.
- If the face value of the Gift Certificate is less than $100, the Gift Certificate does not expire in New Hampshire;
- Gift Certificates are refundable in California.
- If over 90% of the face value of the Gift Certificate is used, the remainder may be refunded in Massachusetts.
